• Senate Commerce Committee hearing on nominee David Redl to be Assistant Secretary for Communications and Information at the Department of Commerce. If confirmed, Redl will be in charge of the National Telecommunications and Information Administration (NTIA), and serve as President Trump's top telecom adviser, including how to expand the nation's broadband infrastructure. Trump has mentioned broadband buildout in his fiscal 2018 budget proposal, as part of infrastructure spending. Redl is currently chief counsel at House Committee on Energy and Commerce, advisor to Chairman Greg Walden (R-Ore.) and panel Republicans on communications and technology matters, and previously was a registered lobbyist and director of regulatory affairs at CTIA, a trade association representing wireless companies such as AT&T, Dish and Verizon. Redl sees the top three challenges facing the NTIA as maximizing how agencies effectively use spectrum, improving broadband reliability – particularly in rural places, and better addressing the needs of the U.S. digital economy.

ICANN Sends Letter To US Senators But Does NOT Answer Questions

"The Board is not aware of any conflicts of interest relating to his [Fadi Chehade] activities during his tenure that would require additional steps to be taken in order to remain consistent with ICANN’s policies in effect relating to conflicts." --Steve Crocker, Chairman of the ICANN Board of Directors, April 6, 2016 Letter to U.S. Senators Cruz, Lee, Lankford--see embedded below-highlighting added:



What were the Questions the US Senators were seeking answers to? They were numerous, none of which were answered by Steve Crocker. See letter of April 4 embedded below:



Finally, in regard to Crocker's claim of no real or potential "conflicts of interest," this is a continuing, systemic problem within ICANN, that goes all the way to the top and formed the basis for the US Government threatening to pull the IANA contract away from ICANN in 2012:
The New York Times March 18, 2012: "A boardroom dispute over ethics has broken out at the organization that maintains the Internet address system after its most important supporter, the United States government, reproached the group for governance standards said to fall short of “requirements requested by the global community.”..." (emphasis added)
In fact, some members of the ICANN community recognized and agreed that Fadi Chehade's activities in China constituted a real or potential conflict of interest requiring referral to ICANN's Corporate Counsel in accordance with ICANN policy, but apparently every member of the ICANN Board of Directors failed to recognize, much less refer as required by ICANN policy, the matter--see transcript (pdf) of Non-Contracted Parties House, Intersessional Meeting  at ICANN, February 5, 2016, excerpts below:



Following which a long discussion occurred among ICANN stakeholders at the meeting, discussing whether to send a letter of inquiry to the Board to find out whether the Board had done anything in compliance with ICANN's conflicts of interest policy. Apparently the ICANN Board did not comply with ICANN's own conflicts of interest policy, nor even recognized a real or potential conflict of interest--just another failure of corporate governance inside of ICANN? 

At the very least, this is just another indication that the ICANN Board of Directors needs its own independent legal counsel--not ICANN's legal staff nor Jones Day--and obviously,  needs to be educated about "conflicts of interest."

As reported by RollCall, the Senate voted 83-14 to limit debate on the USA Freedom Act which resurrects and revises some of the lapsed Patriot Act - NSA surveillance provisions. Final vote on the bill is expected later today. However the Senate plans amendments to the House legislation (HR 2048) which will continue the revived provisions for between 6 months and one year. However, the legislation as amended and approved by the U.S. Senate today will "face an uncertain fate in the House, which passed the USA Freedom Act by a substantial margin prior to last week’s recess."

UPDATE: Rand Paul Will Force Patriot Act Provisions to Expire: "... invoking cloture on the first vote is just the first step of many, with the clock ticking. That cloture vote merely sets up another vote on proceeding to the bill. There are up to 30 hours of debate in order after the first cloture vote, before voting on the motion to proceed to the bill, of which Paul is entitled to one. If no one else joins Paul [note: other Senators have now joined Rand Paul, including Democrat Senators Wyden and Heinrich], in chewing up floor time with hour-long speechifying, the Senate could then vote on adopting the motion to proceed Sunday evening. But without Paul’s consent the programs in question would go dark because McConnell would still have to file a cloture motion to end Paul’s filibuster of the bill itself. And that vote, under the rules, wouldn’t occur until 1 a.m. Tuesday at the earliest. Under the rules, cloture motions must sit through an intervening day, which would be Monday if McConnell were able to move to cut off debate on a bill on Sunday. Following that 1 a.m. Tuesday cloture vote, again assuming all possible speed, Paul would be entitled to chew up another hour talking on the floor. That’s with maximum speed. If Paul finds an army of senators backing his filibuster, the process would take even longer due to the 30-hour rule..."
