Read last week's News Review, and News Review 2)a. 2019-06-02, and note the .AMAZON applications are "on hold" due to Colombia's Request for Reconsideration which raises the same point I raised in News Review 2)b. 2019-05-26: "the .AMAZON applications now violate Specification 13 ..."
GAC Communique: "... V. Follow-up on Previous Advice - The following items reflect matters related to previous consensus advice provided to the Board. 1. .AMAZON applications: The GAC asks the Board to explain in writing whether and why it considers that its decision to proceed with the .AMAZON applications, based on a proposal [17 April 2019] that the eight Amazon countries considered did not address their concerns, complies with GAC Advice ...." "This is a distraction from the EPDP Team’s work. We were informed that the TSG was a purely technical exercise. Now, we are being told this model is being taken to the DPAs. This has confirmed the fears this Team had regarding the TSG. It is not ICANN org or the TSG’s job to be developing policies - it is the ICANN community’s job."--EPDP feedback to ICANN Org

UPDATE 1 July 2019: CAPTURE Complete--"On 30 June 2019, ICANN (Internet Corporation for Assigned Names and Numbers) and Public Interest Registry, entered into a renewal Registry Agreement (pdf) [removing all price caps on .ORG domain names] under which Public Interest Registry operates the .org top-level domain."--ICANN.org. The multi stakeholders and bottom up process that is supposed to govern ICANN policy? Ignored. The public outcry was nearly universally against this change. They weren't listened to at all. Did ICANN's board vote on the proposed contract after being briefed about the public outcry? As of [this] writing, I couldn't find any evidence in ICANN's board activity page. No agenda, no minutes, no resolutions, no briefing material, no preliminary report. Did ICANN staff simply push through this contract without a board vote? ..."
----------------
Original entry: The Case for Regulatory Capture at ICANN--https://reviewsignal.com/blog/2019/06/24/the-case-for-regulatory-capture-at-icann/  by Kevin Ohashi--excerpt (Conclusion) below, with an in-depth examination of the conflicts of interest and corruption rampant within ICANN and its processes, specifically in reference to the .ORG price cap issue, with numerous individuals and organizations cited, including Public Interest Registry (PIR), Internet Society, Verisign, Shane Tews, Steve DelBianco, Jonathan Zuck, Greg Shatan, Judith Hellerstein, Maureen Hilyard, and more.

Conclusion
"The public interest is at best being represented, in majority, by people tied up in potential conflicts of interest in the given matter. At worst, it looks like special interest groups for VeriSign and The Internet Society (ISOC) / Public Interest Registry have captured multiple groups at ICANN and are trying to use it to line their organizations' pockets.

"This appears to be a case study in regulatory capture. Beyond public outcry, there appears to be very little stopping ICANN from simply pushing through these contracts despite overwhelming evidence that the average internet user isn't in favor of these changes. There is virtually no meaningful argument in favor of removing price caps, unless you accept that it would be administratively easier for an organization with hundreds of millions of dollars in the bank. There is a bizarre free market argument that falls apart when you realize the cost of lock-ins for using a domain name and creating a web presence on any domain. .ORG is a thirty million dollar subsidy to the Internet Society (via PIR) which outsources, via competitive bid, the actual registry services. And they want the ability to charge more, at the expense of every other non profit. Their interests strongly align with VeriSign, who most likely see .ORG as the last hurdle before getting .COM and .NET to have price caps removed and increase their bottom line even more in their non competitive monopoly contract.

"The only step left before these changes go into effect, that I am aware of, is board approval. I think it probably will go through unless there is a tremendous amount of attention brought to the issue. I'm not only concerned about price caps on .ORG, but structurally the only people who can invest so much time and money participating in ICANN are the organizations which stand to financially gain the most. Who is representing the public interest? Registry groups appear to have a strong voice within the ICANN community. Finally, I also worry about potential conflicts of interest at the board level, which has twenty members. Five ICANN board members were or are connected to ISOC (1,2,3,4,5). One is a former board member of PIR as well. I hope they recognize their responsibility to do what is right for everyone and not the select few registry operators in this instance." (emphasis added)

3) Names, Domains & Trademarks
graphic "Names, Domains & Trademarks" ©2017 DomainMondo.com
Editor's note: remember all the lies touting new gTLDs used by incompetent ICANN Org management and staff, the unethical ICANN Board of Directors, and the corrupt   "ICANN community" con artists, including their preposterous growth projections?
 Oracle Dyn Domain Registration
https://dyn.com/domain-registration/

"I can't find anything online yet and waiting for the office to open to confirm. Going to be a pain in the ass, we have over 500 domains with them and was trying to add more this morning and rejected ... Oracle Dyn is no longer offering Domain Registration, Standard DNS, and Secondary DNS. Customers with existing service should monitor the email associated with their account for further communication."--source: Reddit.com.

a. Oracle laid off sales and marketing staffs at Dyn (n/k/a Oracle Dyn / Oracle America, Inc.), a formerly independent DNS services provider and domain name registrar it acquired in 2016 for $600 million. Dyn users are getting "EOL" or end-of-life notices for products, and Oracle Dyn's landlord has put Dyn's offices in Manchester, N.H., up for lease, leading some to speculate more layoffs are to come.

b. Should I register a domain with GoDaddy?-- Benny from Pasadena. "Benny wants to create a website and wants to know if he should register a domain with GoDaddy. Leo says NO. He hates GoDaddy and their questionable business practices. And there are plenty of other domain registrars out there. Leo recommends HOVER [Tucows]" --techguylabs.com (emphasis added).

c. Tucows [NASDAQ: TCX]: 3 Terrible Businesses In 1 | SeekingAlpha.com: "Tucows' Domains business is suffering similar stagnation. Industry-wide, growth is abysmal. GoDaddy (NYSE:GDDY) and VeriSign (NASDAQ:VRSN) have been suffering low single-digit growth, while TCX's own revenue CAGR has been 1% over the last 3 years as it's been losing market share. The business is highly commoditized, with little to differentiate any individual firm other than price. TCX has been boosting prices to inflate growth metrics, but this will simply accelerate churn and share loss." (emphasis and links added).

d. Fraudsters are taking advantage of the increased number of new top level domains to register lookalike domains – for example, the letter "m" can be replaced by the letters "r" and "n" to give the appearance of "m" and it's something which many users won't notice at first glance--zdnet.com.

e. "Bargain basement gTLDs and glyph attacks using IDNs are powering phishing attacks, with fraudulent registrations on the rise. Worse yet, phishing sites are increasingly getting security certificates"--techrepublic.com.

f. FUCT: Los Angeles streetwear designer Erik Brunetti, who had been turned down by U.S. Patent and Trademark Office when he sought to register the brand name FUCT (domain: fuct.com) as a trademark, won in the U.S. Supreme Court--Supreme Court allows foul language trademarks in F-word case. [Editor's note: not hard to imagine what's coming next, including as trademarks and .BRAND new gTLDs -- ICANN will have completely FUCT UP the internet and global DNS.]

d. GAC Communique (pdf)--Manal Ismail (Egypt) is GAC Chair for the term March 2019 - March 2021. Communique highlights:

CCWG-Accountability Work Stream 2: "... One intervention raised an issue on possible future steps that need to be taken in order to address the concerns regarding ICANN jurisdiction stated in the Jurisdiction Sub-Group Final Report and Recommendations, and expressed that this issue remains open and requires further consideration by GAC and ICANN Board. There are different views on this matter in the GAC.

Issues of Importance to the GAC: 1. Dot Amazon applications; 2. Two-Character Country Codes at the Second Level; 3. IGO Protections.

GAC Consensus Advice to ICANN Board:

•  WHOIS and Data Protection Legislation: The GAC advises the Board to: i. Take necessary steps to ensure that the GNSO EPDP on the Temporary Specification for gTLD Registration Data institutes concrete milestones, progress reports and an expeditious timeline, similar to Phase 1, for concluding Phase 2 activities; ii. Take necessary steps to ensure that the scope of phase 2 activities is clearly defined with a view to expeditious conclusion and implementation; iii. Make available the necessary resources for Phase 2 to expeditiously advance on the complex legal issues deferred from Phase 1; iv. Consider instituting additional parallel work efforts on technical implementations, such as that carried out by the Technical Study Group, for purposes of informing and complementing the EPDP’s Phase 2 activities; v. Facilitate swift implementation of the new Registration Directory Services policies as they are developed and agreed, including by sending distinct parts to implementation as and when they are agreed, such as the questions deferred from Phase 1; vi. Consider re-starting implementation processes for relevant existing policies, such as rhe Privacy Proxy Services Accreditation Issues Policy.

•  ICANN Board Consideration of the CCT Review Recommendations: The GAC notes with concern the recent Board resolution in response to the Final Recommendations of the Competition, Consumer Trust and Consumer Choice Review Team, which approved only 6 of 35 consensus recommendations. The GAC advises the Board to: i. Promptly meet with the CCT Review Team leadership to discuss the Board’s resolution; and ii. Possibly reconsider certain decisions on recommendations if appropriate.

•  Subsequent Rounds of New gTLDs: The GAC recalls its advice in the ICANN56 Helsinki Communiqué, which states that the development of policy on further releases of new gTLDs needs to fully consider all the results of the relevant reviews and analyses to determine which aspects and elements need adjustment. The GAC advised the Board to address and consider these results and concerns before proceeding with new rounds.

The GAC will next meet during ICANN65 in Marrakech, Morocco, 24-27 June 2019.

e. EPDP Phase 2 (and Phase 1 Implementation)
EPDP (Phase 2) meetings will restart after new EPDP Chair appointed by GNSO Council (no later than 25 April 2019). More on EPDP at ICANN64 on last week's News Review.
At ICANN64, ICANN's Brad White interviewed GNSO Chair Keith Drazek and GNSO Council Liaison & EPDP Acting Chair Rafik Dammak about the Expedited Policy Development Process (EPDP).

f. ICANN64 Post-Meeting Report | ICANN.org. See also last week's News Review for more on ICANN64 including videos. Finally, a few ICANN64 Quick Takes:
  • Q1 2022 is a tentative possible date for next round new gTLDs application window to open.
  • Cathrin Bauer-Bulst (EU): DPAs [EU Data Protection Authorities] "cannot engage in this travel circus we’re engaged in. We need to do our homework and then consult them."
  • Opening Ceremony, Cherine Chalaby: "Our new vision for ICANN is to be a champion of the single, open and globally interoperable Internet and the trusted steward of the Internet's unique identifiers."
  • Public Forum 1, former ICANN Board member Bruce Tonkin: ICANN doesn’t prioritize processes. It does everything at once, and that means too many things are done poorly in parallel. We need to prioritize what’s most important at any one time and work on those few things well.
  • ICANN Governance session, former ICANN Board Chair Steve Crocker: "GDPR has taken over our attention span. We could have seen it coming years ago. We should have solved the privacy issues inherent in GDPR by ourselves way before GDPR. Those issues are fundamental ...  Something’s broken in our DNA that we wait to be pushed, and pushed hard, by external forces ..."

2) Other ICANN News
graphic "ICANN | Internet Corporation for Assigned Names and Numbers"
a. New gTLD .AMAZON: the ICANN Board "calls on the ACTO member states and the Amazon corporation to engage in a last effort that allows both parties over the next four (4) weeks to work in good faith toward a mutually acceptable solution regarding the Amazon Applications, and if one is reached, to inform the Board of that solution by 7 April 2019."--ICANN Board Resolution (pdf) March 10, 2019.

b. RPMs PDP Working Group Dysfunctions and ICANN Expected Standards of Behavior:
c.  ICANN terminated the Registrar Accreditation Agreement (RAA) with registrar Alpnames Limited (IANA #1857), effective immediately (March 15, 2019). "The RAA was terminated after the ICANN organization determined that Alpnames was no longer performing required registrar functions as specified in the agreement. These functions include allowing existing registrants to renew domain name registrations and processing new registrations." More here and notice of termination (pdf).

Tucows Inc. (NASDAQ: TCX) FORM 10-K | Annual Report | sec.gov excerpt:
"We may not be able to maintain or improve our competitive position and may be forced to reduce our prices because of strong competition in the market for Internet services generally and domain name registration, in particular, which we expect will continue to intensify. Each registry and the ICANN regulatory body impose a charge upon the registrar for the administration of each domain registration. If these fees increase, this may have a significant impact upon our operating results. Regulation could reduce the value of Internet domain names or negatively impact the Internet domain acquisition process, which could significantly impair the value attributable to our acquisitions of Internet domain names."

UPDATES Feb 14: GNSO Council Extraordinary meeting 21:00 UTC (4pm EST in US).
Item 3: COUNCIL DISCUSSION – Final Report of the Expedited Policy Development Process on the ICANN Board Temporary Specification on gTLD Registration Data (50 minutes).
"... we will receive an update from the EPDP WG Leadership and have an opportunity as Council to ask questions, discuss the report, next steps, etc. We will then plan to vote on the Final Report on 21 February, or during another special Council meeting scheduled for 4 March, if needed. Voting before ICANN65 will allow the GAC to consider an approved Final Report during its face-to-face meetings in Kobe, allow for a 40-day public comment period, and give the ICANN Board sufficient time to consider the report and public comments before approving in advance of the May 25 expiration of the Temp Spec. Accordingly, there is no room for a deferral beyond the 4 March meeting."--GNSO Chair Keith Drazek (RySG - Verisign)
GNSO Council Meeting Audio Cast via browser or app. Transcripts and recordings on GNSO Calendar. February 14 Meeting Agenda embed below:

  • Margie Milam (EPDP member, BC - Facebook) email Feb 14: "... Since there was consensus to publish the Initial Report, the Council should have simply notified the EPDP Team in November that it had no objection to proceeding to Phase 2.  Indeed, this reference to the Initial Report confirms that there was no intent to wait until consensus for the Final Report. In our view,  it is problematic to change the interpretation of the Charter midstream during the EPDP’s deliberations for those stakeholder groups and constituencies that relied on this interpretation of the Charter ... Per the charter, work on an access model should have begun late last year.  Instead this work has been deferred to Phase 2 of the team’s work.  What is unclear is when the EPDP team will take up its remaining responsibilities under the charter and produce an actual “final” report - – which must occur prior to the expiration of the Temp Spec on May 25, 2019. We hope this helps clarify our thoughts as the Council considers these procedural issues in its call later today.  We’d like to encourage the Council to ask the EDPD Leadership to create a timeline for producing the Final Report -Part II that brings the work to a close in an expedited manner."
  • Response to Milam's email above from Milton Mueller (EPDP member, NCSG - Georgia Tech).
  • Response to Milam's email above from GNSO Chair Keith Drazek.

UPDATES Feb 12:
  • Margie Milam (EPDP member, BC - Facebook) email Feb 12: "... I am genuinely confused about the directions given to the GNSO Council since this report – although it is misnamed a “Final Report” is really only an “Phase 1 Interim Report” since the PDP has not concluded, and the charter questions have not been answered.  As a result, is seems that the voting thresholds to create a consensus policy and the vote required under the Bylaws do not yet apply until the Phase 2 work is complete. I understand the desire to call this a Final Report, but  there is a significant amount of work that has not been done yet, as outlined in the draft report being circulated, with key areas missing ..." (emphasis added)
  • Response to the above from GNSO Chair Keith Drazek via EPDP email Feb 12.
  • ICANN staff email to EPDP: "... any statements that your group want to see accompany the Final Report need to be submitted by Friday at the latest. As a reminder, even if your group supports the recommendations and consensus designations, groups have the ability to submit statements that are to accompany the Final Report ..."
  • EPDP Consensus Call - Bundle #3 (pdf) embed below: "... Bundle 3 of the consensus designations. As some items are still in discussion or newly minted, I have held off assigning a designation to those. To make it clear, I have created two separate tables (3A and 3B). I have taken a conservative approach in holding back a final designation where we have not received feedback on final wording. However, I do think we have agreement on nearly all of these and look forward to closing them out by the end of this week. Please comment on Table 3A by the end of this week if you disagree or wish to discuss the level of consensus indicated. Please use Table 3B  to consider your response so that we can request a rapid turnaround on that table when it is issued."--Kurt Pritz, EPDP Chair Feb 12, 2018 (EPDP Mail List).
EPDP Consensus Call Bundle #3:

Original Post:
As indicated in an update in last week's News Review, the EPDP 'drop dead date' was extended to  Feb 25. The EPDP working group is now scheduled to submit a "draft" (latest version) of its "Final Report" (Phase 1) to the GNSO Council on Monday, February 11, after one last EPDP plenary meeting that same day (details further below, including revised timeline).
"... it was completely unrealistic to think that under the current pressure we would come up with something. Some of us said that from the get-go. Turns out we were right even if we worked in good faith. So we should consider anything we get in an interim policy as success. We've got a lot more mapping done. We've got a lot more of the issues out. This is a slow process, correcting 20 years of inattention. And I think one of the most important products that we can include in that interim policy is a list of things that we've already identified as needing revision to be compliant with GDPR."--Stephanie Perrin, EPDP member and NCSG Chair, Toronto EPDP F2F, Jan 18, 2019, transcript (pdf), p.58.

EPDP recap for week ending Feb 9: EPDP plenary meetings Feb 5, Feb 6, Feb 7, Data Elements group Feb 5. [Editor's note: Legal committee Feb 6 cancelled.]  Highlights:

EPDP Mail List Feb 5, 2019: Proposed Revised "Registration Data" Definition
"... The Temp Spec  contains this definition:  "Registration Data" means data collected from a natural and legal person in connection with a domain name registration." The "in connection with" language is so broad and vague that it could be interpreted to data that registrars and registries would not consider to be registration data such as billing data, account creation data, and the like. RySG [gTLD Registries Stakeholder Group] proposes to revise the definition to reference the relevant data elements:  "Registration Data" means the data elements identified in Annex [X], collected from a natural and legal person in connection with a domain name registration."  (Annex [X] would then identify the relevant data elements, as carried over from the whatever becomes the final version of Recommendation 4) ... "--Kristina Rosette, Senior Corporate Counsel, IP - Domains, Amazon.com, Inc. (RySG).

Feb 5: Kurt Pritz, EPDP Chair (appointed by GNSO Council): "... And question two will demonstrate how far out of my depth I am but you know ..."

c. Technical Study Group [TSG] Makes Progress at First Face-to-Face Meeting | ICANN.org 04 Feb 2019: "... the ICANN organization [would] serve as the sole entity receiving authorized queries for non-public registration data, obtaining such data from generic top-level domain (gTLD) registries and registrars, and then passing that data to the third-party requestor. The TSG's aim is to develop a technical design and specification that could be used by implementors to determine whether a unified access model would be possible under the European Union's General Data Protection Regulation  [GDPR] ... The group also agreed on several assumptions, detailed in our updated charter. We will explain all these in detail when we produce our final technical model ... We are all coming to the ICANN64 meeting in Kobe, where we plan to hold a community workshop to present our work and solicit your feedback ,,."  See ICANN's Technical Study Group on Access to Non-Public Registration Data | ICANN.org.
