03 May 2019 Letter from Pearse O'Donohue (European Commission) to ICANN CEO Göran Marby [embed below] re: European Commission Policy Recommendations of the Expedited Policy Development Process (EPDP), in reply to 26 Apr 2019 Letter from ICANN CEO Göran Marby.

Editor's note: interesting discussion on the EPDP public mail list (thread:"European Commission comments on Phase 1 report - additional information") re: letter above, including the following exchange (emphasis added):
To: Chris Disspain, ICANN Board Liaison to EPDP
"We appreciate your relaying of information about ICANN Corp’s interactions with the EDPB [European Data Protection Board]. We also appreciate your efforts to clarify certain positions. With this last message, however, I think you are in danger of crossing the line into advocacy of a particular position, and this is inappropriate. Under the ICANN bylaws the community develops policy and the board reviews and approves community developed policies with an eye to the larger picture. As a board liaison to the EPDP, your job is to serve as an information channel between the team and the board and to advise the EPDP team about any issues and concerns the board has that the EPDP might not be taking into account. It is not to advocate for a particular position.
"With regard to “UAM,” it is already established policy, as developed by phase 1 of the EPDP, that we are no longer talking about “access” models we are talking about disclosure models.  See Recommendation 3 of the final report, which has been approved by the Council. So we’d appreciate it if you get up to speed and adopt the approved and correct terminology.
"Legitimately, the EC [European Commission] is motivated by BOTH the need to comply with its own law AND its desire for convenient disclosure processes. There is no inherent tension between these two as long as the disclosure processes are consistent with data protection principles. That will be a difficult job, so let us work it out. All stakeholders and views are represented here; the EC can and does speak for itself. So we don’t need your attempt to push a tendentious interpretation of their views upon us.
"Finally, when you say this: '….. that the EC’s view is that attempts to narrow ICANN’s purpose are counter-productive and the current wording needs to be revisited.'
"No…you are so far off base that it is laughable. The EC’s position on Purpose 2 could not be clearer. It was directly challenged in their comments. Taking out selective snippets and trying to twist their words in ways that conform to the position you are pushing is not helping this process at all. It is also, as I said before, not an appropriate thing for a board member to be doing. Please stay in your lane, and let the multistakeholder process work.--Dr. Milton L Mueller [NCSG], Georgia Institute of Technology, School of Public Policy, Internet Governance Project.
Response from Chris Disspain:  "Thanks Milton. You are, of course, entitled to your opinion. Cheers, CD."

2) Other ICANN News

a. Postscript to ICANN's Proposals for Unlimited Price Gouging of .ORG and .INFO registrants
(emphasis added):
"This is a sad day for the DNS industry. ICANN is not giving any consideration to end consumers (registrants.) This is yet another example of how the ICANN multi-stakeholder model does not work. ICANN chooses time and time again to ONLY act in the very narrow interest of contracted registries, including Pubic Interest Registry (PIR), Verisign and others. What is being proposed here is to give PIR the unrestricted ability to increase prices on its base of 10+ million registrants by any amount, with no restrictions whatsoever. PIR will be able to do this without any type of justification. PIR can wake up one morning and decide to arbitrary increase prices by 30%, 300% or even 3000% and this price hike will be fully permitted under the ICANN new proposed .ORG Registry Agreement between ICANN and PIR. So you have a situation where any price increases will be forced upon by 10+ million end-user registrants -- and nobody will be able intervene and make sure consumers are protected. End-users will have no choice - but to pay the higher, unjustified fees. This is extremely BAD for consumers. This is BAD for the millions of organizations that use a .org domain name. These organizations will have no choice but to pay higher fees and be entirely at mercy to PIR. It is virtually impossible to switch away from a .org domain name and use an alternative extension, simply because of enormous switching costs ...." –Don
"Wake up people! ICANN and the registries want to steal your domain names!"--onlinedomain.com.
"In my STRONG opinion, ICANN is a corrupt racketeering organization. It's a crime syndicate that advances interests of a few insiders at the expense of the masses and the general good. They have abused their power and their role."--ricksblog.com.

1) Why Apple $AAPL Is Losing In India

Why Apple Lags Behind Samsung And Xiaomi In India

Why is Apple $AAPL struggling to reach one of the fastest growing smartphone markets in the world?

In the fourth quarter of 2018, Apple reported selling about 47 million iPhones worldwide. But Apple is still struggling to make a dent in India, where high import duties and price-sensitive consumers have resulted in weak sales. Apple began selling iPhones in India more than ten years ago but is still struggling in the world's second-largest smartphone market.

According to research firm Counterpoint (counterpointresearch.com) data, Samsung and Xiaomi led in smartphone sales in India in the third quarter of 2018, with 22 percent and 27 percent of the smartphone market, respectively. In the same period, Apple made up only about one percent of India's smartphone market share, behind Chinese phone makers Vivo and Oppo. CNBC.com video above published Jan 29, 2019.

2) Amazon $AMZN Analysts Alarmed?

Amazon $AMZN delivered its third consecutive record quarterly profit in the fourth quarter of  2018 but raised alarm among some analysts with a cautious first-quarter sales forecast. Financial Times (ft.com) video above published Feb 1, 2019.

1) EPDP Meetings After Toronto F2F
EPDP Meetings are scheduled on Tuesday, 22 Jan 2019, and Thursday, 24 Jan 2019, at 14:00 UTC (9am EST) for 3 hours each.

Observers may use Adobe Connect, or audiocast via browser / app. Links: EPDP Initial Report  (pdf); comments to the Initial Report; PCRT Public Comment Review Tool; GNSO Council EPDP page and updates; links to EPDP meeting transcripts and recordings are on the GNSO calendar. • 21 Jan 2019 email from EPDP Chair: "Attached is a status of our work. The first is an overall status outline all issues [embed below]; the second is a tabular listing of the status of each Purpose and Recommendation [embed below]. Please read both docs to get a complete picture. We will follow up with guides for each of the upcoming meetings."

Overall status :

Tabular listing:

Highlights of the EPDP Toronto F2F:
1. First Day (Wednesday, 16 Jan 2019, transcript pp. 22-23)  What Are We Doing? (Stephanie Perrin is NCSG Chair):

2. First Day (Wednesday, 16 Jan 2019, transcript pp. 37-38) : Whose Purposes?

Editor's note: Why is this EPDP so dysfunctional? In part, the answer lies in the same seven factors that lead to stupidity:
"People think stupidity is the opposite of intelligence. In fact, stupidity is the cost of intelligence operating in a complex environment. It’s almost inevitable ... seven factors that lead to stupidity ... being outside of your circle of competence, stress, rushing or urgency, fixation on an outcome, information overload, being in a group where social cohesion comes into play, and being in the presence of an 'authority.'"--Farnam Street | fs.blog.
Unfortunately, all seven factors were present in Toronto at the EPDP F2F.

2) .WEB IRP UPDATE
Afilias Domains No. 3 Limited v. ICANN re: new gTLD .WEB (IRP proceeding)

Editor's note UPDATE 24 Jan 2019: ICANN appears to be in violation of the ICANN Bylaws by not publishing any of the documents filed by Afilias in the IRP:since 27 November 2018 without any notice of what documents are being wholly redacted:

Each IRP Panel may, in its discretion, grant a party's request to keep certain information confidential, such as trade secrets, but only if such confidentiality does not materially interfere with the transparency of the IRP proceeding.--ICANN Bylaws Art. 4, Section 4.3(u).

d. Why Facebook, Google, et al, Wanted To Kill Off RSS--corporate control and "ownership" of all "news" and "information"--own "everything"--
Google Reader is just the latest casualty of the war that Facebook started, seemingly accidentally: the battle to own everything. While Google did technically “own” Reader and could make some use of the huge amount of news and attention data flowing through it, it conflicted with their far more important Google+ strategy: they need everyone reading and sharing everything through Google+ so they can compete with Facebook for ad-targeting data, ad dollars, growth, and relevance.--Marco Ament, 2013 as quoted in  motherboard.vice.com.

1) Semiconductor Chip Wars: China vs U.S.

The Economist.com video above published Dec 11, 2018: The trade war between China and the U.S. is not just about traditional products like steel and cars. A battle for dominance is under way in semiconductor chips, as the two superpowers fight to control this vital industry.

2) Why Netflix $NFLX Is Struggling In India

Netflix has 137 million subscribers and a majority of them are international. But the streaming giant is still struggling to break into India, the world's second-largest internet market. CNBC's Alex Sherman explains why.

Netflix is currently valued much higher than other media companies. Despite a share pullback in recent months from more than $400 to about $285, Netflix has a trailing price-to-earnings ratio of more than 100 and an enterprise value-to-EBITDA ratio of about 70. For comparison, Disney has a P/E ratio of about 14 and an EV-to-EBITDA ratio of about 11. Viacom's valuation ratios are both around 7.

This gaudy valuation is largely predicated on its international growth forecast. Breaking into India is critical for the company to double or triple its subscribers over the next 10 to 15 years, as many analysts have estimated. But Netflix hasn't had an easy time spreading through India since it launched there in 2016. Faced with competition from local players and Amazon Prime Video, Netflix is facing an uncertain future in a country with more than 1.3 billion people. CNBC.com video above published Dec 11, 2018.

Slowing growth in China, growing disarray concerning UK, Brexit, & the EU.

Investing Notes: The Macroview
“It is quite possible there will be a global recession”--Jeffrey Gundlach, Dec 11, 2018.  The U.S. is stronger than the rest of the world, according to Gundlach, with real growth at 3.0%. U.S. leading economic indicators (LEIs) remain strong, and are not close to turning negative, which would signal a recession. But global LEIs are much weaker, Gundlach said, and approaching zero. As central banks tightened their monetary policies, equity returns have been hit. 75% to 80% of global markets are in a “death cross” pattern, where 50-day moving average has fallen below the 200-day moving average. Europe is “absolutely horrible” in terms of economic growth, according to Gundlach. Editor's note: nothing of import was said or happened at the August 9th EPDP Team meeting. The "Triage" exercise is a HUGE waste of time, hardening differing positions before substantive discussions have even begun. The EPDP Team Chair, Kurt Pritz, is obviously struggling (anyone surprised?) with both process and substantive issues. The meeting eventually devolved into periods of silence in the Adobe Connect room until the EPDP Chair ended the meeting early. The 'smartest guy usually in the room' (Professor Milton Mueller) wisely absented himself from Thursday's exercise in group dysfunction.

"Initial indications are that the level of consensus is low."--Kurt Pritz, EPDP Chair

The EPDP Chair's "Six Realizations" as of August 7, 2018:

Original Post:
1) ICANN Loses Appeal in Germany vs EPAG (Tucows affiliate). ICANN has failed in its attempt to enforce terms of its Registrar Agreement which German domain name registrar EPAG maintains violate provisions of the European Union's General Data Protection Regulation (GDPR), enacted in April, 2016 (published 4 May 2016), and which became enforceable May 25, 2018.
ICANN v. EPAG Domainservices, GmbH
"The Applicant's [ICANN's] immediate appeal of 13 June 2018 against the order of the Regional Court of Bonn of 29 May 2018 (10 O 171/18), in the version of the non-remedy order of 16 July 2018, is rejected .... The Senate was under no obligation to refer the case to the ECJ [European Court of Justice] pursuant to Art. 267 TFEU, because the interpretation of provisions of the GDPR was not material to the decision ..."--Higher Regional Court of Cologne (pdf in German--English translation of German original above, emphasis added).
English Translation of Order from the Higher Regional Court of Cologne, Germany Regarding ICANN’s Immediate Appeal (pdf) full embed below (personal identifiable information redacted by ICANN):

ICANN's response to the appellate court's ruling:
"ICANN is considering its next steps, including possible additional filings before the German courts, as part of its public interest role in coordinating a decentralized global WHOIS for the generic top-level domain system and will provide additional information in the coming days."

a. GDPR & WHOIS: EPDP next meetings Tuesday, August 7, and Thursday, August 9, starting at 13:00 UTC 9am EDT, each day. Non-members of the EPDP Team, observers and alternates not replacing members, may listen via live audio cast:
Following the first EPDP Team meeting on August 1, 2018, Milton Mueller, NCSG (non-commercial stakeholder group) member of the EPDP Team, sent the following via the EPDP mail list:
As noted in the call, and in keeping with the charter, NCSG will refrain from addressing any access issues until the gating questions have been answered by consensus. We urge other stakeholder groups and ACs to do the same. We regret that the [ICANN] staff has disregarded the charter and has continued with what Berry [Cobb, ICANN staff] and Kurt [Pritz, EPDP Team Chair] admitted was “a mistake.”--Dr. Milton L Mueller, Professor School of Public Policy, Georgia Institute of Technology (emphasis added).
Mueller was responding to a prior email from ICANN staff:
In order to facilitate the triage of the Temporary Specification as outlined in the EPDP Team Charter as the first deliverable, please work with your appointing organization team members to complete the below surveys. Please find the relevant survey links and accompanying deadlines below:
1. Part 1, due Monday, 6 August 2018 by 23:59 UTC: https://www.surveymonkey.com/r/CC6F9F8

4. Part 4, due Sunday, 19 August 2018 by 23:59 UTC: https://www.surveymonkey.com/r/9KD5K79
Later, ICANN staff member Marika Konings responded to Mueller's email above, on the EPDP mail list:
"Milton, please note that per the discussion during yesterday’s meeting, the question specific to the Annex was removed from Part 4 of the survey. Instead, a comment box was added that allows those that want to provide further input, including on the annex to do so, but per the charter, any deliberations on the topics outlined in the annex will only commence after the gating questions have been answered. As such, any input provided in relation the annex will be parked until the moment that the gating questions have been addressed. I hope that addresses your concern."
