Economist.com video above published Aug 28, 2018: Over one billion hours of YouTube videos are viewed every day and a new generation of content creators are harnessing the power of the social-media platform, but they're also grappling with issues surrounding censorship and free speech. A new breed of creatives, known as influencers, are the modern broadcasters of the internet age, some as young as four years old, who are streaming their content to millions of viewers.

YouTubers are also increasingly using the platform and global audience to push the boundaries of free speech and promote their own brand of positive values, but not just a western, influencers around the world freely express their opinions.

In places where free speech has been suppressed in the past, freedom of speech comes with its difficulties. Like Facebook, Twitter and other digital platforms, YouTube is forced to grapple with complex decisions about censorship. It aspires to be politically neutral, but doesn't allow hate speech.

The line between free speech and hate speech is a fine one. Without the contest of ideas, the world cannot progress. Influencers like these may be at the heart of our democratic future.

Question: I want to ask you your thoughts on privacy at a time when these technology companies are so successful, more successful and more powerful than they ever have been in terms of having so much information on all of us, you backed Hulk Hogan's successful triumph over Gawker Media and that sex tape that they resulted in a 140 million dollar judgment against Gawker forcing the media company into bankruptcy. You're a libertarian, I want to get your take on how you see the privacy issues versus this powerful position so many of these technology companies are in. I'm leaning to a question about regulation but first why was this Gawker situation so important to you?
Answer: "Well I think that I'm very proud of having supported Hulk Hogan in his in his a successful lawsuit, you know this sort of egregious [conduct], the claim that you know a pornographer pays people for sex tapes and a journalist is someone who gets to publish sex tapes without paying people that's simply an insult to journalists and that's what that is what Gawker was in effect arguing. You know there is a First Amendment we believe in, free speech, but that doesn't mean that you get to steal a sex tape made in the privacy of a bedroom and post it on the internet for everybody to see and ... of course we have a Fourth Amendment which protects you against unreasonable search and seizure not just by the government but certainly also by by private actors ... I'd seen them [Gawker] you know bully and mistreat people for you know for a long time and I thought it was going to continue ... this ongoing tortious behavior was simply going to continue and someone needed to to try to say stop ...

"This question about privacy in the digital era is something that deserves to be rethought a lot and it's not a matter of technological determinism. We often like to tell these technologically determinist stories where if you are pro privacy you are a Luddite and that privacy is an old-fashioned concept, it went out the window and it's no longer possible in the technological world.

"I don't think that's true. I think it is not always just a technological question. It's a legal question, it's a cultural, social, political question and I think that we're going to have a balance that will be, it will protect more privacy in the future. Now I do think that what Gawker did and what the big tech companies are doing is very different. I mean I think one very basic difference is if you voluntarily give the information, that's quite different from from it being sort of illegally obtained and sort of privacy violating way, but I think these things are always open to be rethought ... as a libertarian I always dislike regulation and worry the regulators will do whatever they will do in an even more ham-handed way and will make mistakes even greater than the companies ... but I would agree with you, that if they don't take these issues seriously, there is a risk they will be regulated whether that's a good thing or not. I think the threat is probably greater in Europe and again there's sort of good reasons and bad reasons. Good reasons are these privacy concerns. The bad reasons are that there are no successful [big] tech companies in Europe and they're jealous of the U.S. and ... they're punishing us, so it's sort of a combination of good and bad reasons but I think the tech industry needs to take this stuff [privacy] very seriously."

Turkey, Russia, France, Germany: Top Countries In Twitter Censorship

In the first six months of 2017, 90 percent of all removal requests to Twitter came from just four countries: Turkey, Russia, France and Germany:

The latest Transparency Report from Twitter ( $TWTR), also revealed which national governments have sent the most requests for users' information in the first half of 2017(see chart below). By a large margin, the United States is at the top of the list. Of the 2,111 account information requests made, Twitter responded 77 percent of the time with at least some data. A total of 4,594 accounts were specified in the requests. And while Turkey made 554 requests, on no occasion did Twitter produce information for Erdoğan's government. Twitter's compliance rate varies significantly between countries. In the top ten list above, Italy had the most success with a rate of 78 percent, compared to India with just 21 percent, and Turkey with 0 percent.

The focus points, per Japanese media, would be high-speed trains, liquefied natural gas facilities in Asia to help expand exports of U.S. natural gas, and expanding nuclear energy-related sales. •  Mad Dog an "instant hit" in Asia | Axios.com: "That's how the Associated Press describes the welcome given to Trump's Secretary of Defense [retired U.S. Marine Corps General James 'Mad Dog' Mattis] in Japan and South Korea ... " Why it matters: China has been making illegitimate territorial claims and actively working to dominate and initmidate its Asian neighbors.

•  U.S. crude oil exports will surpass production in four OPEC nations in 2017, due to a resurgence in shale oil and gas, which Trump is counting on to create jobs and rebuild roads, schools and bridges, and may grow even more according to Bloomberg.com.

•  Extreme obstruction tactics by Senate Democrats are backfiring. A boycott of the Senate Finance Committee by Democrats in an attempt to thwart Trump's Cabinet nominees was cheered by liberal activists but "infuriated" Senate Finance Committee Chairman Orrin Hatch (R-Utah), who called the tactic "pathetic" and Democrats "idiots." Committee rules require at least one member from each party to be present for a meeting, but when Democrats boycotted the Committee, the Committee's Republicans simply changed the rules Wednesday to allow confirmation votes to proceed: “We took some unprecedented actions today due to the unprecedented obstruction on the part of our colleagues," Hatch said. The longer the unprecedented Democratic obstruction and grandstanding goes on, the more skilled Republicans in Washington will become at changing rules and procedures, which will leave Democrats with even less power than they otherwise have now. (Not a smart strategy if you're a Dem.)

•  Trump Cabinet status report on three of the most important positions for investors:
  • Secretary of State: Rex Tillerson, confirmed and sworn-in February 1, 2017;
  • Secretary of Commerce: Wilbur Ross, approved by committee January 24th, awaiting Senate confirmation
  • Treasury Secretary: Steven Mnuchin, approved by committee February 1, 2017, awaiting Senate confirmation

Rex Tillerson is one of Trump's best picks, it has been a long, long time since the U.S. has had a Secretary of State of his caliber:

Just think, we don't have to worry anymore about having a politician Secretary of State maintaining a homebrew email server with classified material, blaming Benghazi and Mideast violence on a YouTube video, exclaiming "what difference does it make" when American lives are lost, disclaiming responsibility for incidents like Benghazi, making a mess of Syria and Libya, or 'leveraging' her position as Secretary of State in various "pay to play" schemes.

•  President Trump's nominee for the Supreme Court, Judge Neil Gorsuch, will be confirmed:
  1. He is eminently qualified and has wide support, e.g., Special report on Supreme Court nominee Neil Gorsuch | rcfp.org:  Reporters Committee for Freedom of the Press finds Judge Gorsuch's decisions in libel and invasion of privacy cases reflect solid First Amendment principles.
  2. Chuck Todd said on NBC's live coverage of Trump's announcement that Gorsuch is so impressive that his confirmation "should be a layup -- he meets all of the criteria ... made an incredible first impression." Chuck said that in this environment, confirmation will still be "noisy" because of the pressure on Dems from their base. Nevertheless, "I think it's going to be much harder for them to unify and be against and force a filibuster after he spends one-on-one time with them."--Axios AM | axios.com
  3. Ultimately, the Democrats cannot stop confirmation--115th Congress (2017-2019): Senate Majority Party: Republican (52 seats); Minority Party: Democrat (46 seats) + 2 Independents who caucus with the Democrats. Total Seats in the U.S. Senate: 100, and Vice President Mike Pence can vote to break any ties. Currently a successful filibuster threat requires a supermajority of 60 needed in favor of cloture, in order to confirm a Supreme Court nominee. Republicans have the option to invoke the nuclear option which would change the rules to allow Supreme Court nominees to be confirmed by simple majority without threat of filibuster. President Trump has already indicated that if necessary, Senate Republicans should invoke the nuclear option in order to confirm Gorsuch. Rejections of Supreme Court nominees are relatively uncommon, the Senate has explicitly rejected only twelve Supreme Court nominees in its history. The most recent rejection of a nominee by vote of the full Senate occurred thirty years ago when the Senate refused to confirm Robert Bork in 1987.

News Review: New gTLDs Registry Rightside Sells eNom, What's Next?

Feature •  Surprise announcements by buyer and seller early Friday, Presidential Inauguration Day in the U.S., new gTLDs registry operator Rightside Group, Ltd. (NASDAQ: NAME), sold its domain registrar business operating under the brand name eNom (eNom.com), to Tucows Inc. (domain: tucows.com) (NASDAQ: TCX) (TO.TC), and investors apparently liked the "win-win" deal:
  1. Dave Wilson's stock of the day: Tucows NASDAQ:TCX (audio mp3) 
  2. Both $TCX and $NAME ended UP Friday, although Tucows had the larger gain:

Tucows' CEO Elliot Noss acknowledged eNom's growth prospects were neutral to negative but cited anticipated cost synergies over the next 24 months and the deal's additional cash generation as justification for the acquisition in a conference call and webcast Friday which is available for replay.

Toronto-based Tucows is a provider of network access, domain names and other Internet services, including Ting (ting.com) mobile phone service and fixed internet access, OpenSRS (opensrs.com) domain registrar services (15 million domain names, a global reseller network of over 13,000 web hosts and ISPs), as well as Hover (hover.com), a domain name registrar. Rightside's filing with the SEC in connection with the deal stated, in part:
"On January 20, 2017, Rightside Group, Ltd. (“Rightside” or the “Company”) and its wholly owned subsidiaries, Rightside Operating Co. (“Seller”) and eNom, Incorporated (“eNom”) entered into a Stock Purchase Agreement (the “Purchase Agreement”) with Tucows Inc. (“Tucows”) and Tucows (Emerald), LLC, a wholly-owned subsidiary of Tucows Inc. (the “Purchaser”), pursuant to which the Purchaser will purchase Rightside’s eNom business through the purchase of all of the outstanding stock of eNom from Seller in exchange for $83.5 million, less a net working capital adjustment of $6.8 million, resulting in net cash at closing of $76.7 million (the “Transaction”). The purchase price is subject to customary adjustments following the closing, including a working capital adjustment to the extent such amount is greater or less than the estimated net working capital amount determined at closing. At the closing, the Company will pay transaction expenses of approximately $4.0 million and substantially all of its existing indebtedness. The transaction is expected to close on January 20, 2017."
That SEC filing also disclosed (emphasis added):
" ... On January 20, 2017, the Company entered into a Limited Consent and Amendment No. 4 to Credit Agreement (the “Amendment”) by and among the Company, its domestic subsidiaries Rightside Operating Co. and eNom (together with the Company, the “U.S. Borrowers”), its foreign subsidiaries DMIH Limited, United TLD Holdco Ltd. and Rightside Domains Europe Limited (collectively the “Non-U.S. Borrowers” and together with the U.S. Borrowers, the “Borrowers”), Hot Media, Inc. and Acquire this Name, Inc., as guarantors, and Silicon Valley Bank (“SVB”), as lender and collateral agent. The Amendment revises the terms of the Company’s existing Credit Agreement, dated as of August 1, 2014, as amended (the “SVB Credit Facility”), by and among the Borrowers and SVB, which provided a $30.0 million revolving loan facility with a $15.0 million subfacility for the issuance of letters of credit. The Amendment, among other changes, releases eNom as a party to the SVB Credit Facility and the assets sold in the Transaction from the collateral securing the obligations under the SVB Credit Facility; suspends the availability period for revolving loans, requires the Company to repay the outstanding revolving loans in full and reinstates the availability period once the Company satisfies certain conditions, including further amendments to the SVB Credit Facility and delivery of projections giving effect to the Transaction; lowers the total commitment from $30.0 million to $15.0 million; suspends the application of the financial covenants until the availability period for revolving loans is reinstated; and amends the financial covenants that will have effect once the availability period for the revolving loans is reinstated, including the maximum consolidated net leverage ratio, minimum liquidity ratio and minimum consolidated EBITDA. The Amendment further consents to the Transaction." 
Friday's closing price on Rightside ($NAME) gave it a market capitalization of $178.9 million. Rightside stated Friday in its press release: "Following the transaction, Rightside will be in a strong financial position with approximately $90 million in cash on its balance sheet."  Subtract the $90 million in cash, and the market is valuing Rightside's remaining businesses, principally Name.com registrar and Rightside registry (new gTLDs), at $88.9 million. In July, 2016, Rightside rejected an unsolicited offer from privately-held Donuts to buy Rightside's new gTLDs for $70 million in an all-cash deal.

Question: Is the market overvaluing or undervaluing Rightside's remaining businesses?  See Rightside Q3 2016 financial results. It will be interesting to see the Q4 2016 and Q1 2017 financial results.
